that poll that ago regated the midwest which i don't think includes of course, virginia, that showed romney up by five over president obama. that doesn't break it down state by state. we'll have the numbers as soon as we get them. >> we'll see you right back here at 4:00. steve handelsman. thank you so much. >>> in court today, a judge warned the former d.c. council chair kwame brown, don't tempt fate with the violation of the terms of his release. he was placed under a curfew and ordered to make weekly visits with officials. he had to go back to court after failing three time to make required weekly phone calls to check in. brown pleaded guilty in june to bank fraud and campaign finance violation. he is hoping to avoid prison time by cooperating with the prosecutors. brown will be sentenced next month. >> 11 people have now died from that meningitis outbreak linked to tainted steroid injections. the latest confirmed death happened last night in tennessee bringing that state's death toll up to six now. there have been 119 confirmed cases of meningitis across ten states. virginia has confirm

in that key state have been getting plenty of time with president obama and his republican rival mitt romney. both candidates campaigned hard in the buckeye state tuesday. in fact, romney is spending four out of five days there this week. the reason, a new cnn orc poll shows it is a close rate for ohio's 18 electoral votes with 51% of likely voters backing president obama, 47% for romney. that, of course, made closer after last week's debate. meanwhile, ohio's election chief, a republican, has asked the supreme court to reinstate a new law that cuts off the final three days of early voting. an appeals court blocks the law pushed through by state republicans. as romney continues to campaign in ohio, president obama is back in the white house this morning. nbc's tracie pots joins us now with all the latest from washington, tracie, good morning. >> reporter: good morning, lynn. good morning, everyone. the president is closing the gap in a number of these battleground states and it continues to say the $5 trillion tax cut romney's proposing would add to the deficit and romney insists it is absol

:00. >>> mitt romney has enjoyed a boost in several polls from a strong debate performance, but it's a new poll out this morning of voters in swing states that may hold the most encouraging news for the former governor. the poll by nbc news, marist and "wall street journal" shows romney closing the gap in three states. ohio, florida, and right here in virginia. it is virginia that is considered one of the most importan states of this election where romney is really gaining some ground. he now leads the president there 48% to 47%. that is a three-point swing from last week when he trailed by two points. in ohio is where we're also seeing some new numbers this morning. the president still leads there, though. romney has gained two points, though, in the last week to shrink the advantage to 51-45 right now. the president also leading in florida this morning, but only by one percentage point, well within the margin of error for this poll. the only good news for the president here, it is the same lead he held during last week's poll. >> while mitt romney can't be in all key states all the time, his

to be made up for this campaign. polls show that president obama is still holding a lead over governor romney in ohio. but those polls also show that the governor is closing in, within striking distance now of the president. speaking of the president, he also was in ohio this week and admitted publicly that he had a bad night out in denver for that first presidential debate. obviously a lot of republicans and democrats agreed with his assessment. the president said he was too polite and that voters can expect him to see him being a lot more active in the second debate up at hofstra university in new york. back here in ohio, paul ryan's got a big day here. he's got two stops in ohio, starting with this rally a little later this morning, and then he'll go up to minnesota before ending the night in wisconsin. he's expected to take sunday off the trail, little rest for the weary, if you will. >>> earlier, i sat down with "morning joe," asking them how they thought undecided voters would react to all the fireworks. >> i think the undecided said you know what? we'll watch some baseball this week. s
